These Terms of use (“Terms“) govern your use of any website, mobile, tablet or desktop application (“Service” or “Services“), either directly provided by Rock And More Radio (“RMR“)” or via third party integrations with other platforms. Review these Terms carefully before using the Services. By using any of the Services, you accept these Terms.

Changes. From time to time RMR may change, update or modify these Terms. If you continue to use the Services after RMR changes the Terms, you accept all changes.

Privacy Policy. RMR Privacy Policy describes RMR practices concerning data that you provide or that RMR may collect about you through the Services, and your consent to our use of data in compliance with the Privacy Policy.

Additional Terms. Additional terms may apply to your use of the Services. RMR may use, including, but not limited to, mobile or desktop applications, either provided by RMR itself or by third parties, integration with other websites, social platforms, audio stream internet addresses that might be used in audio players etc. If necessary, RMR will provide additional terms to you or post them on the Services to which they apply; they are incorporated by reference into these Terms. If there is a conflict between these Terms and any additional terms that apply to a particular Service, the additional Terms will control. Some Services can utilize software provided by a third party, who may require that user be bound by their own Terms of Service and/or privacy policies (“Third Party Policies“). While agreement to Third Party Policies may be required in order to utilize certain Services provided via those third parties, the Third Party Policies are a separate agreement between the user and such third party. In the event of any conflict between the Third Party Policies and Terms of Use of RMR, RMR Terms and Policies will govern the RMR Services and the Third Party Policies will govern those third party services.

RMR does not necessarily endorse or evaluate third-party content and websites, and RMR does not assume responsibility for third parties actions or omissions. You should review third parties terms of use and privacy policies before you use their services.

Governing Law, Venue, and Jurisdiction. These Terms and all claims arising from or related to your use of the Services will be governed by and construed in accordance with the Laws of Romania, without regard to the conflict of law rules thereof. With respect to any disputes or claims, you agree to exclusive jurisdiction in the courts of law of Romania. Notwithstanding any other provision of these Terms we may seek injunctive or other equitable relief from any court of competent jurisdiction. Regardless of any statute or law to the contrary, you must file any claim or action related to use of the Services or these Terms within three months after such claim or action accrued. Otherwise, you will waive the claim or action.

Content. The content of websites, images, scripts, applications provided for Service use, either in source code or binary format, is the property of RMR. RMR may use third party source code, fonts, either verbatim or as derivative work, open source components governed by various licenses such as public domain, GPL, Apache License etc. These third party components are provided for ensuring the Service and such content is not property of RMR. The media content provided may be property of RMR or is provided by RMR as licensed content.

        Warranties and Disclaimers. RMR provides Services in the hope you will enjoy using them, but RMR does not promise Services guarantees.
        OTHER THAN AS EXPRESSLY SET OUT IN THESE TERMS OR ADDITIONAL TERMS, NEITHER RMR NOR ITS SUPPLIERS OR DISTRIBUTORS MAKE ANY SPECIFIC PROMISES ABOUT THE SERVICES. FOR EXAMPLE, RMR DOES NOT MAKE ANY COMMITMENTS ABOUT THE CONTENT WITHIN THE SERVICES, THE SPECIFIC FUNCTIONS OF THE SERVICES, OR THEIR RELIABILITY, AVAILABILITY, OR ABILITY TO MEET YOUR NEEDS. WE PROVIDE THE SERVICES “AS IS”.
        SOME JURISDICTIONS PROVIDE FOR CERTAIN WARRANTIES, LIKE THE IMPLIED WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. TO THE EXTENT PERMITTED BY LAW, WE EXCLUDE ALL WARRANTIES.

TO THE EXTENT PERMITTED BY THE LAW, THE TOTAL LIABILITY OF RMR FOR ANY CLAIMS UNDER THESE TERMS, INCLUDING FOR ANY IMPLIED WARRANTIES, IS LIMITED TO THE AMOUNT YOU PAID TO RMR, OR, IF RMR CHOOSES, TO SUPPLYING YOU THE SERVICES AGAIN. IN ALL CASES, RMR WILL NOT BE LIABLE FOR ANY LOSS OR DAMAGE THAT IS NOT REASONABLY FORESEEABLE.

        About these Terms. RMR may modify these terms at any time or any additional terms that may apply to a Service for various reasons, including but not limited to changes to the law, changes to RMR Services etc. You should look at the Terms regularly in order to ensure your Services use. RMR posts notices of notifications of these terms on this page. Changes are not applicable retroactively and will become effective no sooner than 14 days after they are updated. If you do not agree to the modified Terms for a Service, you should discontinue your use of that Service.
        If there is a conflict between these terms and the additional terms, the additional terms will control for that conflict.
        These terms control the relationship between with RMR and you. They do not create any third party beneficiary rights, nor they are transmissible or inherited.
        If you do not comply with these terms, and RMR does not take action right away, this does not mean RMR is waiving the rights it might have.
        If a particular term is not enforceable, this will not affect any other terms.
        The laws of Romania, excluding Romania’s conflict of laws rules, will apply to any disputes arising out of or relating to these terms or the Services. All claims arising out of or relating to these terms or the Services will be litigated exclusively in the courts of law of Romania, and you and RMR consent to personal jurisdiction in those courts.
